DEPOSITS AND PAYMENT.
To secure a reservation a deposits of $500 per client and a completed booking form must be sent to Scotland's Island Experience (hereinafter referred to as the Operator). The balance of payment must be made by 31st January. Balances may be paid later but no less than 60 days before departure, but there will be a charge of 10%. All payments will be acknowledged with a receipt.
ITINERARY.
Upon completion of all payments and not less than four weeks prior to the start of the tour, each client will receive by mail a detailed itinerary of the tour.
CANCELLATION.
In the event of cancellation of a tour by the Operator all deposits and payments will be refunded. in full.
Cancellation by the client must be made by letter or fax. Cancellations charges will apply as follows, if proper written notice is received: 90 days or more before departure - $50 charge; 50-89 days before departure - $200 charge; 21-49 days before departure - a charge of 1/3 of the tour price; 5-20 days before departure - a charge of 2/3 of the tour price; within 5 days before departure, the total tour price will be retained.
RESPONSIBILITY.
The Operator and/or its agents acts only in the capacity of agent for its clients in all matters concerning transportation, accommodation, visits and services. All tickets, vouchers and contracts issued are subject to all terms and conditions specified therein and their acceptance by the client shall be deemed to be consent to the further condition that the Operator and/or its agents shall not be liable for any injury, damage or loss to, or in respect to, any person or property arising from such transportation, accommodation, visits or services, howsoever caused or arising; shall not be liable for any damage or inconvenience caused by late airline, ship .ns, rail or motor coach arrivals or for cancellation or delays in departure or return; and shall no be liable for any injury, damages, or loss caused to any client by terrorist activities, mechanical or constructional difficulties, disease, quarantines, social or labour detentions, theft, government regulations, local laws, climatic actions, omissions or conditions outside the Operator's control.
The Operator and/or its agents will take all reasonable precautions to prevent injury, damage or loss to clients during tours and shall not be liable for any injury, damage or loss caused by the unreasonable, or inadvised behaviour of the client.
The Operator and/or its agents, if deemed to have caused injury, damage or loss to any of its clients, by neglect, may only be pursued in a Scottish Court of Law.
BAGGAGE.
Small articles - coats, umbrellas, hand bags, cameras etc. are entirely under the client's care and all baggage is carried at 'owner's own risk' throughout the tour.
RESERVATION OF RIGHTS.
The Operator reserves the right to withdraw or cancel the described tours; to refuse or retain any client as a member of the travel group at any time, and to make changes in the printed itinerary, whenever, in its sole judgment, conditions warrant or if it deems it necessary for the convenience or safety of its clients.
PRICE.
All prices are based upon tariffs and rates of exchange in effect in October. Prices are liable to change without notice at or before the time of full payment, or departure, in the event of unavoidable changes in exchange rates or costs. The Operator reserves the right to levy any surcharges on the client, provided such surcharges have been notified not less than 14 days in advance of the start of the tour.
